Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the Unveiled mobile application (the "App") and the services made available through it (together, the "Service"), provided by Botsonic (Pty) Ltd (registration number K2022592441), a South African private company trading as Unveiled, with its registered office at 55 Borghorst Street, Monte Vista, 7460, Cape Town, South Africa ("Unveiled", "we", "us", or "our").

By creating an account, signing in, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Unveiled is an AI-powered bridal styling app. You upload a selfie, choose styling options, and the Service generates a preview image of you in different bridal looks using a third-party AI model. Generated images are stored in your account and may be saved to your device.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using the Service you confirm you meet this requirement.

3. Your account

You are responsible for keeping your sign-in credentials confidential and for all activity on your account. Notify us immediately at support@unveiled.co.za if you suspect unauthorised access. We may suspend or terminate accounts that we reasonably believe violate these Terms.

4. Acceptable use

You agree not to use the Service to:

• Upload images of any person other than yourself, unless you have that person's clear, informed consent.
• Upload images of minors in any context.
• Generate, request, or share content that is sexually explicit, violent, hateful, harassing, defamatory, or that promotes illegal activity.
• Impersonate another person or misrepresent your identity.
• Reverse-engineer, decompile, scrape, or attempt to extract the underlying models, prompts, or source code.
• Resell, sublicense, or redistribute access to the Service.
• Interfere with the Service's operation, security, or other users' enjoyment of it.
• Use the Service to develop a competing product or to train another AI model.
• Use the Service in any way that breaches applicable law.

We may remove content and suspend or terminate your account, without notice, for any breach of this section.

5. Content and licensing

5.1 Content you upload

You retain all rights you have in the photos and other content you upload ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free licence to host, transmit, process, and display Your Content solely as needed to provide the Service to you (including transmitting it to our AI sub-processor for generation).

You represent and warrant that you have all necessary rights in Your Content and that uploading it does not infringe anyone else's rights.

5.2 Generated images

Subject to your compliance with these Terms, we grant you a worldwide, non-exclusive, perpetual, royalty-free licence to use, reproduce, modify, and share the images the Service generates from Your Content ("Generated Images") for your personal, non-commercial purposes. You may also use Generated Images of yourself for ordinary commercial purposes such as your own social media or wedding marketing, provided the use does not breach Section 4.

Because of how generative AI works, we cannot guarantee that any particular Generated Image is unique or free from similarity to other outputs. You acknowledge that other users may receive similar outputs from similar inputs.

5.3 Our rights

We may use Generated Images and aggregated, de-identified data about how the Service is used to operate, secure, and improve the Service. We will not publicly use a Generated Image that depicts you in a way that identifies you without your consent.

6. AI output disclaimer

The Service uses generative AI. Generated Images are not photographs, may contain inaccuracies, may not match real-world products, designers, gowns, or venues, and should not be relied on for any decision where accuracy is critical. Any resemblance to a real person other than yourself is unintentional. The Service is provided for entertainment and inspiration only.

7. Subscriptions, free tier, and payments

• The Service offers a free tier with a limited number of generations per period, and one or more paid subscription tiers offering additional generations and features.
• Subscriptions are billed by Apple or Google through their app stores in accordance with their terms. We do not receive your payment card details.
• Subscriptions auto-renew at the end of each billing period unless cancelled at least 24 hours before the period ends. You can manage or cancel your subscription in your Apple ID or Google Play account settings.
• Prices, generation quotas, and features may change. Where changes affect your existing subscription, we will notify you and you may cancel before the change takes effect.

8. Refunds

Refunds for in-app purchases are handled by Apple and Google according to their refund policies. We do not process refunds directly. If you believe you have been charged in error, contact Apple Support or Google Play Support, and let us know at support@unveiled.co.za.

9. Third-party services

The Service depends on third parties including Google Firebase, OpenAI, RevenueCat, Apple, and Google. We are not responsible for the acts or omissions of these third parties. Their terms and privacy policies apply to your interactions with them. See our Privacy Policy for the list of sub-processors.

10. Intellectual property

All rights in the Service (other than Your Content) — including the App's code, branding, designs, prompts, and underlying technology — are owned by us or our licensors. Nothing in these Terms transfers any of those rights to you, except for the limited licence to use the Service in accordance with these Terms.

11. Termination

You may stop using the Service and delete your account at any time from within the App, by emailing support@unveiled.co.za, or by submitting our web deletion form at https://www.unveiled.co.za/delete-account.

We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have breached these Terms, if required by law, or if continuing to provide the Service to you would expose us to legal or commercial risk.

Sections that by their nature should survive termination (including Sections 5, 6, 12, 13, and 14) will continue to apply.

12. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any specific Generated Image will meet your expectations.

Nothing in these Terms excludes any liability that cannot be excluded under applicable law (including liability for fraud, gross negligence, or death or personal injury caused by negligence).

13. Limitation of liability

To the maximum extent permitted by law:

• We will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with the Service.
• Our total aggregate liability for all claims arising out of or related to the Service, in any twelve-month period, will not exceed the greater of (a) the amount you paid us for the Service in that period, or (b) ZAR 1,000.

14. Indemnity

You agree to indemnify and hold harmless Unveiled, its directors, employees, and contractors from any claim, loss, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or your infringement of any third party's rights through Your Content.

15. Changes to these Terms

We may revise these Terms from time to time. If we make material changes, we will notify you in the App or by email at least seven days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service and may delete your account.

16. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa, without regard to conflict-of-laws principles. The courts of South Africa will have exclusive jurisdiction to resolve any dispute arising out of or relating to the Service, except that we may seek injunctive relief in any court of competent jurisdiction to protect our intellectual property.

If you are a consumer in the European Union, the United Kingdom, or another jurisdiction whose mandatory consumer-protection laws give you rights that cannot be waived, those rights continue to apply alongside this section.

17. General

• Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service and supersede any prior agreements.
• Severability. If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect.
• No waiver. Our failure to enforce any provision is not a waiver of that provision.
• Assignment. You may not assign these Terms without our prior written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
• Apple-specific terms. If you obtained the App from the Apple App Store, you acknowledge that these Terms are between you and us only — not Apple — and that Apple has no obligation to provide support or maintenance for the App. Apple is a third-party beneficiary of these Terms with the right to enforce them against you.
• Google-specific terms. If you obtained the App from Google Play, you acknowledge that the Google Play Terms of Service apply alongside these Terms.
